General terms and conditions for visitors and delegates at The
Specialist Media Show
These Terms and Conditions contain important information please read them carefully.
By booking, registering and/or accepting an invitation to The Specialist Media Show
you agree to be bound by these Terms and Conditions.

1.
|
Application
|
|
|
1.1.
|
These Terms and Conditions shall apply to all Visitors and Delegates attending The
Specialist Media Show.
|
|
|
1.2.
|
These Terms and Conditions shall also apply to all persons or organisations who
the Company engages with in the context of The Specialist Media Show and who are
present during the course of the show, including but not restricted to speakers,
contractors and photographers.
|
|
|
1.3.
|
All offers and invitations are made and Bookings and Registrations accepted subject
to these Terms and Conditions and no addition to, or variation of, such Terms and
Conditions shall be binding unless agreed to by the Company in writing.
|
|
|
1.4.
|
Any Bookings or Registrations made with and confirmed by the Company shall constitute
unqualified acceptance of these Terms and Conditions.
|
|
|
1.5.
|
In the event of conflict between these Terms and Conditions and any other terms
and conditions (of the Visitor or Delegate or otherwise), the former shall prevail
unless expressly otherwise agreed by the Company in writing.
|
|
|
1.6.
|
The Company reserves the right to alter and update Terms and Conditions from time
to time. Those in force for an individual or organisation will be the version applicable
at the time of Booking or Registration.
|
|
|
|
|
|
2.
|
Definitions and Interpretation
|
|
|
2.1.
|
In these Terms and Conditions, unless the context otherwise requires, the following
expressions have the following meanings
|
|
|
|
|
|
“Visitor”
|
means any individual, firm or corporate body (which expression shall, where the
context so admits, include its successors and assigns) which makes a Booking or
Registration with the Company to attend The Specialist Media Show Exhibition and
Workshops;
|
|
“Delegate”
|
means any individual, firm or corporate body (which expression shall, where the
context so admits, include its successors and assigns) which makes a Booking with
the Company to attend The Specialist Media Show Conference;
|
|
“Company”
|
means Beckbrook Ltd, owners of The Specialist Media Show, a company registered in
the United Kingdom under number 6997471 whose registered office is 14 Barn Hill, Stamford PE9 2AE
|
|
“Booking”
|
means the application and purchase of an offer of a conference place by a Delegate
or a visitor ticket by a Supplier, including payment of the advertised price and
acceptance of this by the Company;
|
|
“Registration”
|
means the application by a person working for a Media Owner or Supplier for free
admission to the exhibition and workshops and the Company’s acceptance of
the application;
|
|
“Supplier”
|
means any individual, firm or corporate body (which expression shall, where the
context so admits, include its successors and assigns) which supplies products or
services to Media Owners;
|
|
“Media Owner”
|
means any individual, firm or corporate body (which expression shall, where the
context so admits, include its successors and assigns) which main business is to
create and supply edited content through publications, the internet, events or other
media distribution channels;
|
|
“Conference”
|
means that part of The Specialist Media Show which Delegates pay to hear from expert
speakers and participate in group discussion in a private room;
|
|
“Exhibition and Workshops”
|
means that part of The Specialist Media Show where Media Owners or Suppliers Register
or Suppliers Book to meet and talk to exhibitors and hear from workshop speakers
in the main exhibition hall;
|
|
|
|
|
|
3.
|
Definitions and Interpretation
|
|
|
3.1.
|
The Company will use reasonable care and skill in providing The Specialist Media
Show, including the Conference, Exhibition and Workshops.
|
|
|
|
|
|
4.
|
Payment and Booking
|
|
|
4.1
|
The Delegate or Supplier Visitor shall pay to the Company the Conference Delegate
place or Exhibition and Workshop Visitor ticket price payable, if applicable any
credit card charges plus VAT thereon, at the time of making an advance booking or
at the reception of The Specialist Media Show on the day of the show.
|
|
|
4.2
|
Conference places and Visitor tickets are limited and are offered subject to availability.
|
|
|
4.3
|
Prices for Suppliers and Media Owners may differ and the person or organisation
booking should follow relevant instructions and pay the correct rate at the time
of Booking.
|
|
|
4.4
|
Confirmation with respect to the Conference or Exhibition and Workshops will be
forwarded to the Delegate or Supplier Visitor once payment has been received or
to the Media Owner Visitor once registration is completed in full. This will usually,
but not exclusively, be by automated confirmation from the online booking and registration
system. The Delegate or Visitor will be required to present the confirmation at
the reception of The Specialist Media Show on the day in order to gain admission.
The Company reserves the right to refuse admission to anyone without a valid confirmation
of Booking or Registration.

|
4.5
|
People working for a Media Owner or Supplier can Visit the Exhibition and Workshops
at no cost if they register in full, accurately and honestly completing the registration
form in advance, no later than 48 hours before the show. There may be a charge for
Media Owner or Supplier admission on the day, which can be paid at the reception
of The Specialist Media Show.

|
4.6
|
From time to time the Company will make offers, including, but not limited to, advance
or ‘early-bird’ price offers, promotions and special price or other
offers to particular groups of people. These offers will be specific to the recipient
only, non-transferrable and the Company reserves the right to withdraw and introduce
these at their discretion. Details of the dates, validity, restrictions and other
terms of these offers will be included in marketing material.

|
4.7
|
The Company reserves the right to decline applications by Visitors or Delegates
to Book or Register and refuse admission or insist any Visitor or Delegate leaves
the premises for any reason, without requirement to provide explanation.
|
|
|
4.8
|
Bookings or registrations may not be transferred except for by clause 7.1.3. It
is not permitted to sell Bookings to others.
|
|
|
4.9
|
Delegate booking includes one place at the conference with refreshments. Visitor
registration and booking includes one persons entry to the exhibition and workshops.
Booking and registration does not include travel to or from the Event, any accommodation
or other costs incurred in attending the show.
|
|
|
|
|
|
5.
|
Definitions and Interpretation
|
|
|
5.1.
|
During attendance at the Conference or Visit to the Exhibition and Workshops the
Delegate or Visitor agrees to comply with the following:
|
|
|
|
5.1.1
|
shall behave in accordance with safety regulations, public order regulations, and
other rules applying.
|
|
|
|
5.1.2
|
be obliged to immediately follow any directions and instructions given by officials
of The Specialist Media Show or staff from the venue. Should any official consider
that the Delegate or Visitor is behaving in any manner that contravenes regulations,
standards, directions or instructions, he/she may be denied further attendance at
the Conference or admission to the Exhibition and Workshops.

|
|
5.1.3
|
shall not hinder other visitors, including, but not exclusively, by blocking for
a long period their view of presentations or exhibition displays or by making noise
or other nuisance.
|
|
|
|
5.1.4
|
shall not eat food except in the caf�/restaurant and the outside areas; this being
without prejudice to the obligation to consume some form of refreshment when using
the caf�/restaurant; food and bottles of drinks may not be taken into the exhibition
areas.
|
|
|
|
5.1.5
|
shall only use a mobile phone or other electronic equipment with consideration of
other people.
|
|
|
|
5.1.6
|
shall not touch objects on display unless this is explicitly permitted.
|
|
|
|
5.1.7
|
shall not take photographs or make video or film recordings without written consent
of The Company.
|
|
|
|
5.1.8
|
shall not carry out any commercial activity or promotion except on exhibition stands
without the prior agreement of the Company.
|
|
|
|
5.1.9
|
hand in lost property found to a member of the staff or to reception desk of the
show.
|
|
|
|
5.1.10
|
keep within the areas of the show and conference venue that they are permitted admission
to.
|
|
|
|
5.1.11
|
professional photography and filming may be carried out at the show and Visitors
and Delegates agree that any images featuring them may be used for promotional purposes
In perpetuity.
|
|
|
5.2.
|
Children under 16 years of age are not permitted to enter under any circumstances.
|
|
|
5.3.
|
Exhibition and Workshop visitors are not entitled to access the Conference sessions
or area unless they have Booked as a Delegate
|
|
|
5.4.
|
A Visitor or Delegate shall be liable for any damage caused by any object (or similar)
which he/she has taken with him/her. All bags may be subject to searches.
|
|
|
5.5
|
Confirmations of Booking or Registration are valid for the day of the Show, during
opening times only.
|
|
|
5.6
|
If a confirmation is lost or damaged prior to the show this should be reported to
the Company at least 48 hours prior to the show and a replacement will be issued.
Failure to do so may mean that entry is denied.
|
|
|
5.7.
|
A Visitor or Delegate shall enter the show and venue at his/her own expense and
risk.
|
|
|
5.8.
|
The Company will endeavour to provide Delegates, Visitors and others interested
in the Show with up to date information and other information relating to the Show
but cannot be held liable for non-receipt of that information.
|
|
|
5.9.
|
Delegates should advise of any special access requirements at the time of registration.
|
|
|
|
|
|
|
6.
|
Variation and Amendments
|
|
|
6.1.
|
The Company reserves the right to do the following:
|
|
|
|
6.1.1
|
amend any accidental error or omission in Conference, Exhibition or Workshop description
|
|
|
|
6.1.2
|
amend any offers in order to reflect a change in the circumstances beyond the reasonable
control of the Company;
|
|
|
|
6.1.3
|
vary its schedule of charges from time to time.
|
|
|
|
6.1.4
|
Cancel or change the speakers, format, features, content, location, timing or any
other aspect of The Specialist Media Show, at any time, without liability
|
|
|
|
6.1.5
|
sub contract the performance of any of its obligations to a third party subject
to the Terms and Conditions remaining the same. Where the Company sub-contracts
the performance of any of its obligation under these Terms and Conditions to any
person, the Company shall be responsible for the acts or omissions of the sub-contractor(s)
as if it were an act or omission of the Company itself.

|
7.
|
Cancellations, Termination and Transfer
|
|
|
7.1.
|
If the Delegate or Supplier Visitor wishes to cancel or transfer their booking
to another person they may do so at any time by written notice to the Company provided
that:

7.1.1
|
if cancellation notice is received more than 30 days prior to The Specialist Media
Show then 50% of the payment is refundable
|
|
|
|
7.1.2
|
if cancellation notice is received on or less than 30 days prior to The Specialist
Media Show then none of the payment is refundable
|
|
|
|
7.1.3
|
notice of a wish to transfer booking to another person will be accepted up to 48
hours prior to The Specialist Media Show, thereafter the booking cannot be transferred.
|
|
|
7.2.
|
The Company reserves the right to cancel any booking or registration for any
reason without liability.
|
|
|
7.3.
|
The Company may cancel, postpone or change the date of The Specialist Media Show
or any part of it including the Conference, Exhibition or Workshops at any time,
for any reason whether within the companies reasonable control or not, without liability.,Any
booking or registration will be valid for any new date for the show or the Delegate
or Visitor can apply for a full refund.

|
|
|
|
8.
|
Privacy and Data
|
|
|
8.1.
|
By submitting registration details, Visitors and Delegates agree to allow personal
information provided by them to be held on a database and used by the Company and
companies associated with the show for direct marketing or promotion purposes including
contact regarding their services. Visitors and Delegates who do not wish to receive
such communications should email visit@thespecialistmediashow.com.

8.2.
|
The contact details of registered delegates and visitors may be placed on the attendee
list, which will be passed to sponsoring companies, exhibitors and all attendees
for them to see who is at the conference for the purpose of networking and meetings.
Delegates who do not wish to be included on this list should advise at the time
of booking
|
|
|
|
|
|
9.
|
Websites & Links
|
|
|
9.1.
|
The show website and other marketing and social networking websites may link to
and from other websites for the benefit and convenience of the users. The content
of these websites are maintained by their owners, for which the Company accepts
no responsibility. visit@thespecialistmediashow.com.

|
|
10.
|
Speakers
|
|
|
10.1.
|
Speakers, who may also be Visitors and attendees at the Conference are subject to
the same Terms and Conditions at the show. In addition they, by accepting the invitation
to speak, unless they inform the Company otherwise before the show, agree:
|
|
|
10.2.
|
that the Company may use the speaker’s presentation materials and name for
promoting Delegate and Visitor attendance.
|
|
|
10.3.
|
that the Company may record, video or film the speaker’s session and the recording
may be reproduced and sold as part of the overall conference materials
|
|
|
10.4.
|
That the Company may reproduce the speaker’s presentation electronically and
/ or on paper and these may be distributed or sold as hand-out materials.
|
|
|
|
|
|
11.
|
Liability and Indemnity
|
|
|
11.1.
|
If the Company breaches the agreement by not using reasonable care and skill and
this breach can be remedied the Company will remedy it at no extra cost to the Delegate
or Visitor. If the breach cannot be remedied the Company will refund the Delegate
or Visitor any money paid.
|
|
|
11.2.
|
The Company shall only be liable for damage sustained by the Delegate or Visitor
that is a direct consequence of gross negligence or of an intentional act or omission
on the part of the Company. Liability is in any case limited to the lower of the
following two sums: a) the sum paid out to the Company by its insurance company
relating to that particular claim; or b)reimbursement made to the Company by a third
party with respect to the damage relating to that particular claim.

11.3.
|
If The Specialist Media Show is cancelled or terminated then the following provisions
shall apply:
|
|
|
|
11.3.1
|
where such cancellation or termination occurs due to reasons which are within the
Company's reasonable control the Company shall refund to the Delegate or Visitor
any payment received, within 8 weeks, but no further compensation or payment for
any other reason
|
|
|
|
11.3.2
|
if The Specialist Media Show is cancelled due to circumstances beyond the control
of the Company payments by Delegates and Visitors will not be refunded in full.
|
|
|
11.4.
|
The Company accepts no liability for loss, injury or damage to property or persons
at The Specialist Media Show, whether direct, consequential or indirect including
but not limited to injury, lost property, lost profits, salary, money or savings.
Subject to the extent permitted by relevant law. It is the responsibility of the
Delegate or Visitor to arrange appropriate insurance cover in connection with their
attendance at the show
|

|
11.5.
|
Speakers or exhibitors views and advice are their own and the Company disclaims
all liability for advice and opinions given. Documents distributed at the show are
intended for information only and should not be relied upon
|
|
|
|
|
|
|
12.
|
Force Majeure
|
|
|
12.1.
|
Neither Party to these Terms and Conditions shall be liable for any failure or delay
in performing their obligations where such failure or delay results from any cause
that is beyond the reasonable control of that Party. Such causes include, but are
not limited to: power failure, Internet Service Provider failure, industrial action,
civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war,
governmental action or any other event that is beyond the control of the Party in
question.

|
13.
|
Waiver
|
|
|
13.1.
|
No waiver by the Company of any breach of these Terms and Conditions by the Delegate
or Visitor shall be considered as a waiver of any subsequent breach of the same
or any other provision. A waiver of any term, provision or condition of these Terms
and Conditions shall be effective only if given in writing and signed by the waiving
party and then only in the instance and for the purpose for which it is given.

13.1.
|
No failure or delay on the part of any Party in exercising any right, power or privilege
under these Terms and Conditions shall operate as a waiver of it, nor shall any
single or partial exercise of any such right, power or privilege preclude any other
or further exercise of it or the exercise of any other right, power or privilege.
|
|
|
|
|
|
14.
|
Severance
|
|
|
14.1.
|
If any provision of these Terms and Conditions is held by any competent authority
to be invalid or unenforceable in whole or in part the validity of the other provisions
of these Terms and Conditions and the remainder of the provision in question shall
not be affected thereby.

|
|
|
|
|
15.
|
Copyright
|
|
|
15.1.
|
The Company reserves all copyright and any other rights (if any) which may subsist
in the products of, or in connection with, the provision of The Specialist Media
Show, Conference, Exhibition and Workshops. The Company reserves the right to take
such actions as may be appropriate to restrain or prevent infringement of such copyright.

|
|
16.
|
Law and Jurisdiction
|
|
|
16.1.
|
These Terms and Conditions shall be governed by the laws of England and Wales.
|
|
|
16.2.
|
Any dispute between the Parties relating to these Terms and Conditions shall fall
within the jurisdiction of the courts of England and Wales
|
|
